Our Governing Documents

  • Policies & Community Agreements (PDF)
    A Policy is a statement of legally enforceable rules and regulations with a basis in our Condominium Documents and which has been consented to by the Condominium Owners Association (COA) Board. A Community Agreement, while not legally enforceable, is a statement of shared expectations that has been consented to by the Plenary. The linked PDF is a compilation of all of our Policies and Community Agreements as of September 1, 2024.
     

  • Declaration of Condominium (PDF)
    The Declaration of Bull City Commons Condominium was recorded in the City of Durham's real property records to legally create the condominium. (It gets its name because it "declares" that the condominium has been created). If there is anything in another condominium document that conflicts with a provision of the Declaration, the Declaration wins.

    Whereas bylaws (see below) are primarily focused on the operational aspects of the COA and how it functions, the Declaration is more focused on the rights provided to both the homeowners and the property itself, and how those rights coincide with each other.

    Every community member (including owners, co-owners, tenants, and housemates), as well as guests, must abide by all the rules, restrictions, terms, and conditions found in the Declaration. 
     

  • Articles of Incorporation (PDF)
    Articles of Incorporation were filed with the North Carolina Secretary of State and legally formed the COA and established it as a nonprofit corporation. The Articles are brief and contain basic information about the Association, including its name, location, and purpose.
     

  • Bylaws (PDF)
    The Bylaws were adopted by the COA Board and describe how the Association will self-govern. The Bylaws set out voting rights and procedures. Unit owners automatically become members of the Association and are COA Board members.
